The crime of pimping is the act of receiving money or other item of value from a prostitute, knowing it to have been earned from prostitution. Pandering is the act of compelling or arranging for someone to be a prostitute.
Prior to August 20, 2010, pimping was a Class A misdemeanor for the first offense, and a Class 4 felony for the second offense.
As of August 20, 2010, the offense of Pimping is no less than a Class 4 felony. The offense can be a Class 3 felony if the accused has certain prior sex offenses in his or her criminal history, or if the pimping occurred within 1000 feet of a school. A person cannot be convicted of pimping based on their own prostitution. (See 720 ILCS 5/11-19)
Pandering is always a Class 4 felony.
