Trespassing is entering or remaining in a place without authority. A trespass can be to:

  • a residence (see 720 ILCS 5/19-4),
  • to a vehicle, (see 720 ILCS 5/21-2),
  • to property, (see 720 ILCS 5/21-3), or
  • to specific areas such as state supported land, airports, nuclear facilities, places of public amusement or movie theaters.

In most cases prior notice that entry is forbidden is required. Notice can usually be oral.

In the case of criminal trespass to a place of public amusement, for example, running on the field at a sporting event after a public address announcement stating it is prohibited is all the notice required.

That law has recently been strengthened, and anyone who runs on the field will face a Class 4 felony charge, a mandatory minimum fine of at least $1000.00 dollars, and between 30 and 120 hours of community service.
