Our client was charged with Driving Under the Influence of Cannabis and Possession of Cannabis.
Client, mistakenly believing that Cannabis was legal and that smoking cannabis would result in a ticket only, was pulled over by the police.
After being stopped the client admitted to smoking cannabis, admitted that she had cannabis in her possession, and agreed to take a urine test, which she failed.
Attorney Steven R. Hunter filed and litigated a motion to suppress evidence based on an illegal stop of the vehicle. He proved that the vehicle did not have illegally tinted windows, and therefore all evidence, including the marijuana, the confession, and the results of the urine test, was suppressed.
After all of the evidence was suppressed, the prosecution was forced to dismiss all charges. (TE 053 583).
