Illinois law requires all DUI defendants to go through an alcohol and drug evaluation.
The statute states: "After a finding of guilt and prior to any final sentencing or an order for supervision...individuals shall be required to undergo a professional evaluation to determine if an alcohol, drug, or intoxicating compound abuse problem exists and the extent of the problem, and undergo the imposition of treatment as appropriate."
From first-time offenders to DUI defendants with multiple convictions, anyone in Will County with a DUI charge must undergo the assessment. The purpose of this evaluation is to determine a defendant's relationship with drugs and alcohol and whether they may have any substance abuse issues. Based on the results, the evaluator will recommend a certain treatment program for the participant.
The evaluation includes several parts. First, the evaluator will examine your driving history. Second, if any chemical tests were administered (including a breathalyzer, blood or urine test) during the arrest, the examiner will review the results. Third, the defendant will be asked to take a standardized objective test. Finally, the evaluator will perform in-person interview to elicit any additional information about the severity of a defendant's reliance on alcohol or drugs. Together, all of these results are used to determine the nature of the defendants' relationship to drugs and alcohol and whether substance abuse treatment is necessary.
Based on the results of the examination, the evaluator will assign one of four classifications to the defendant. The classifications are: Minimum Risk, Moderate Risk, Significant Risk, and High Risk. The classification that a defendant receives will determine the type and extent of mandated treatment.
It's important to know that each of these classifications carries a recommended treatment program, but an evaluator has the power to use discretion and propose a longer or more demanding program if they see fit. Ultimately, the Will County court decides whether or not to approve the evaluator's suggestion, but more often than not judges accept these recommendations.
Will County DUI Evaluation Procedure
The evaluation administration process in Will County is unlike most other Illinois counties in that it allows a defendant to choose their provider. However, the defendant does have to foot the bill, and evaluations can range from $150 up to $250 based on the provider's policy.
It is important to obtain the representation of a skilled and experienced criminal defense attorney throughout the evaluation and sentencing process. Without guidance, a defendant could find himself facing a harsher sentence.
