Child pornography is one of the most serious crimes a person can be accused of committing.
It evokes an emotional reaction and a disgust in people that is so strong that the presumption of innocence has a difficult time surviving it. If you or a loved one is accused of this crime, you need an attorney like Steven R. Hunter who is committed to the rights of the accused and who believes that all defendants, regardless of what they are charged with, deserve a fair trial.
Child pornography is a very broad statute that encompasses many things. Under Illinois law, a person who creates, transmits, or possesses images of a person under 18 or who is "profoundly mentally retarded," or induces the victim to pose for images, can be charged with child pornography if the images show an actual or simulated sex act, masturbation, fondling, excretion or urination within a sexual context, a victim bound or fettered in any sexual context, or any lewd pose. See 720 ILCS 5/11-20.1. Even a computer generated image can be child pornography. See, e.g. 18 U.S.C. 2256.
There is no exception under Illinois law for juveniles, and no exception for minors involving their own bodies. Ironically, the statute defines a minor victim as someone under the age of 18, while the criminal code prosecutes anyone over the age of 17 as an adult. Consequently, if a 17 year old girl takes a picture of her own body with a camera phone and emails it to her boyfriend, she can be prosecuted for child pornography. If the boyfriend forwards the picture to a friend, he can be prosecuted too.
